Householders Legal Duty of Care

Since the 21st November 2005, every householder in the UK has been placed under a
duty to ensure that their waste is disposed of properly, and in accordance with the law.
Before this date, the duty only applied to businesses. Every householder is now required
to take reasonable measures to ensure that they only transfer their waste to an
authorised person. An authorised person is either a Registered Waste Carrier, or site that
holds a Waste Management Licence.

The duty of care was expanded to include householders to help in the fight against fly
tipping. If householders only use legitimate contractors, they can be satisfied that their
waste will be disposed of lawfully. Rogue traders will lose custom, and then be forced to
act within the law, or cease trading. Householders who fail to take reasonable measures,
regardless of whether the transfer led to the waste being fly tipped, commit a criminal
offence. The maximum penalty upon summary conviction is
£5,000.

When arranging any waste to be collected householders should:

Ask the contractor if they are a Registered Waste Carrier, and for their registration
number
Confirm that they are registered with the Environment Agency by telephone

An all inclusive
written binding quote (usually
by email) is sent. It will be the total amount
payable. No added extras.

Once commissioned a date for the house
clearance is organised.

At the designated time and place our operatives
arrive to carry out the work in one continuous
process.

An invoice  (and photographs of the completed
clearance ) is sent.
Payment is only made upon the completion
of work and subject to your satisfaction.

We will not be able to make any allowance for items of value.

We will attempt, from what you tell us, to guesstimate the length of time
the job will take and will verbally quote a fee.  

We reserve the right, at invoicing, to amend the fee to take into account the actual time
taken plus the tipping fees and environmental charges we have to pay.            
But no VAT.
And what if we want a quote without the initial assessment?
An alternative to a physical assessment but dependant on accuracy of the photographs.
We reserve the right to adjust a quote if they mislead us as to the details of the task.

Are you locally based or based elsewhere and trying to cover a massive area (even
nationwide). One company uses many websites implying they are based in specific towns
but are really only based in one City not even in Yorkshire.

Can we see testimonials from satisfied clients?  

Is the quote set in all circumstances or are there any circumstances where I may have to
pay more?

Do you charge VAT and is it included in quoted price?  Do you give an allowance for items
of value?

Will you clear all the contents or are you limited to how much you can carry?

If I have to make an assessment of the size of vehicle required what happens if I
underestimate?

BEWARE !!
When comparing websites watch out for web pages that say one thing and another
called "terms and conditions" in another place (usually not obvious and in small print)
which contradicts or allows increases in price.

by and representing a company or companies trading under different names.

Can a House Clearance be done for Free?
RECENT HOUSE CLEARANCE COMMISSIONS conducted by
Town or Country House Clearance (North Yorkshire) in April
and May 2014


In May 2014 Town or Country House Clearance completed the
contents clearance of a three bedroomed semi detached house in
Woodlands Crescent, Harrogate, HG2 7BA.  The clearance was
commissioned by the Executors of a deceased estate.   

On 8 May 2014 town or Country House Clearance removed and
disposed of the residue furniture items from a house in
Chatsworth Grove , Harrogate, HG1 2DX.

On 10 April 2014 a Partner from Town or Country House Clearance
conducted a fixed fee probate valuation on the household contents
and possessions in a house in Woodfield Avenue, Harrogate.


On 7 January 2013 Town or Country House Clearance cleared the
contents from a house in Tentergare Lane Knaresborough HG5 9BH

Town or Country Clearance cleared the furniture, beds, electrical
appliances, personal belongings and bric a brac from a three
bedroom semi detached house and garage. A three operative team
took a full day to complete the task. The house clearance was
organised by family members after a death.

On Saturday 5 January 2013 Town or Country Clearance did a Flat
Clearance in St Marks Avenue, Harrogate.

A two operative team with luton box van cleared the belongings
from a two bedroom flat as the owner had moved to a retirement
home.

On 18 September 2012   - we were commissioned by a Solicitor to
do a house clearance of the extensive contents from a three
bedroom and verminous semi detached house in St Leanords Rd,
Harrogate, HG2 8NS.   We also did a basic garden tidy up, pruned
a tree AND removed three scrap cars.

20 September 2012 - Town or Country Clearance were
commissioned by a family member in Chesterfield to clear a 3 bed
semi detached in Eleanor Rd, Harrogate, HG27AL

Wetherby

14 August 2012 - we conducted a deceased estate clearance of a
bungalow in Overdale Close, Wetherby, LS22 6WW for a family
member residing in the USA.

12 August 2012 - a lady was going into a retirement home and we
cleared her 2 bed cottage in Scotton, HG5

A Strange situation and a Customer

The truthful answer is maybe or maybe not

To conduct a house clearance we incur costs - labour, transport and tipping fees.
We need to these costs and make profit.  We want to help the client reduce fees, so the second
hand value of items is critical.  In over 80% of the house clearances we have conducted this value
reduced fees.

If the
second hand value
a) exceeds these costs we pay the client the difference
b) equals these costs we remove everything for free
c) is lower than our costs we reduce the fee in an agreed way.

If there is no second hand value then you pay for the total clearance. Any fee is only payable after
satisfaction and invoicing.

So the answer to the question is it depends on the size of property, its position, and many other
factors AND the quantity and value of the items inside.
Without an assessment we can't determine any of these factors, or the value of items, so any
telephone quote is meaningless.

After our
free assessment we put the facts into a written quote which is BINDING - any fee will
never go up BUT if we have significantly overestimated it will be reduced.

We will
RECYCLE as much as possible, and DONATE to any designated charity shops.
